Terms and conditions

  1. The CEWE Stiftung & Co. KGaA, located in Oldenburg, Germany, in the following referred to as CEWE, is organising the photo contest "CEWE Photo Award 2019 - Our world is beautiful". The topic of the contest is to capture the beauty of this world at the heart of the photographic scene. An expert jury decides on the final selection of winning entries, and CEWE will be awarding 1,000 high-value prizes. The winning photos will be presented on the "Winners" page of our website. All winners will be notified in writing by email and/or post; see note under 12.
  2. Special challenges with shorter terms will also be awarded within the main contest. These short rounds will be held in different countries (regionally) and, where appropriate, with collaborating partners. The terms and conditions of the main contest apply to all special challenges. Please refer to the corresponding pages with the contest platform for information on differing regulations.
  3. Natural persons who are 18 years of age or older are eligible to participate. Participation is not limited to customers of the organiser and independent of the purchase of goods or services. Should a participant be restricted in their legal capacity, the consent of a legal representative is required. All persons involved in the planning and setup of the contest as well as CEWE employees and their family members are not entitled to participate. The organiser reserves the right, at its own discretion, to exclude persons from taking part in the contest where there are legitimate reasons, for example
    1. in the event of violations of the present terms of participation,
    2. in cases of unfair practices,
    3. in the event of any manipulation aimed at improving the chance of winning or gaining similar advantages, and
    4. if false or misleading declarations are made in connection with the registration or submission of photos.
  4. Participants may upload up to 100 self-made digital photos in the following ten categories "Landscapes", "People", "Nature", "Sports", "Architecture & Infrastructure", "Food", "Travel & Culture", "Animals", "Hobby & Leisure", and "Humour". Participants must hold the unrestricted copyrights and rights of use to these photos and their contents may not infringe on any legal provisions of the country of origin, legal provisions of the European Union, or the personal rights of persons depicted therein. The deadline for participation is 31 May 2019. Participation is only possible online, via the contest website. Submissions which are submitted by post or other means will not be considered for the contest.
  5. Each participant can manage his/her uploaded photos as well as supplementary information and descriptions via the personal user account. Photos must have a minimum size of 1,920 x 1,080 pixels and a maximum file size of 22 megabytes (MB) to upload them. Only submissions in the JPEG file format are permitted. In addition, participants must be in the possession of an original full-size version of each uploaded photo; the organiser may request these original versions from the participant for display in exhibitions or publications in print media as part of the marketing activities outlined below.
  6. The contest organiser reserves the right to delete photo contributions which deviate roughly from the topic guidelines. There will be no notification of the deletion of the photos. In addition, the organiser reserves the right to make changes or additions to the content provided by it at any time and without prior notice, even if these influence the contest's terms and conditions.
  7. By participating in the contest, the participant grants CEWE and affiliated companies the irrevocable, non-exclusive, and permanent rights of use to the uploaded photo(s) for PR activities. This includes the possibility of publication, reproduction, display, and distribution for the purpose of CEWE's self-promotion and self-presentation. This exclusively takes place in connection with the contest and includes the subsequent communication in which the participant took part. This permission includes the use of the submitted photos in the following contexts:
    1. display in exhibitions;
    2. auctioning of exhibits for a good cause;
    3. online publication and publication through social networks (including adaptation of the image format to specific channels such as Instagram or Snapchat, if necessary);
    4. inclusion into other publications, including publications by third parties in press reports; as well as
    5. the presentation of CEWE's services.
    Any commercial use that extends beyond this scope requires the participant's separate consent.
  8. With their participation, participants confirm that they are the author of the uploaded photos and therefore have unlimited right of use. Participants further assure that the photos uploaded by them are free of third-party rights; in particular that all recognisable persons depicted in said photos agree to the specified uses and that third-party property rights are not infringed upon. The participant already now indemnifies CEWE against any third-party claims.
  9. Whenever the organiser publishes the submitted photos, participants will always be named as the creator together with their full name.
  10. The participant assures that the contents of the transmitted image files do not violate applicable (German) standards of prohibition, in particular regulations to combat the distribution of child pornography (§§ 184 et seqq. StGB [German Criminal Code]). Entries that infract upon the law, glorify violence, pornography, racism, contain other offences, or which are aimed at manipulating the contest will be removed by the organiser. There will be no notification of the deletion of the photos.
  11. The photos are published free of charge within the scope of the publication conditions. The material prizes and/or vouchers offered by the organiser through the "Prizes" page will not be paid out in cash and any exchange is excluded. Prizes are additionally excluded from transfer to third parties.
  12. Note regarding point 1: If a winner does not report him-/herself within 14 days of notification, any claim to prizes will forfeit and the contest organiser may select another winner as an alternative. This also applies to winners of a special monthly contest.
  13. Participants can withdraw photos from the contest at any time by deleting them through their personal user account; however, photos that are displayed on the "Winners" page after the judging process are excluded from withdrawal.
  14. By uploading the photos, the participant agrees to the contest terms and conditions. The contest and these terms and conditions are exclusively subject to the laws of the Federal Republic of Germany. No right of appeal exists.
  15. Severability clause: If a provision of these contest terms and conditions is or becomes wholly or partially invalid, the validity of the rest of these terms and conditions shall not be affected. The invalid provision shall be replaced by the legally permissible regulation which comes as close as possible to the economic purpose and intent initially expressed through the invalid provision. The same shall apply in the event of a loophole in these contest terms and conditions.
  16. Disclaimer for the use of the CEWE Photo Contest App for iOS: We would like to point out that Apple Inc. does not participate in the realisation of this contest, nor does Apple Inc. sponsor this contest. No Apple Inc. products are included as contest prizes. In addition, Apple Inc. is not in any way responsible for this app or its use.
